Terms of Service

1. About RentalHive
RentalHive ("we," "us," or "RentalHive") is a peer-to-peer equipment rental marketplace operating in British Columbia, Canada. We provide an online platform where owners ("Listers") can list items for rent and renters ("Renters") can book them. Together, Listers and Renters are referred to as "Users."
RentalHive is a marketplace intermediary only. We do not own, inspect, or warrant any listed items. Rental agreements are between Listers and Renters directly.
2. Eligibility
You must be at least 19 years old (the age of majority in BC) and have legal capacity to enter binding contracts. By using RentalHive, you confirm you meet these requirements. We may require identity or payment verification at any time.
3. Accounts
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at support@rentalhive.ca if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.
4. How Rentals Work
- Renters submit a booking request for the dates and item they want.
- Listers review and confirm or decline the request within 48 hours.
- Payment is collected at the time of confirmation and held in trust until the rental is marked returned.
- Listers receive their payout (less the platform service fee) after the item is marked returned and any applicable dispute window has passed.
5. Fees and Payments
Service fee: RentalHive charges a platform service fee on each completed booking. The applicable percentage is displayed before you confirm any booking.
Security deposit: Some listings include a security deposit. This amount is authorized (held) on your payment card at booking and released within 5 business days after the item is returned, provided no damage claim has been submitted within the 72-hour damage-claim window.
Taxes: Rental amounts displayed are exclusive of applicable taxes. RentalHive collects and remits British Columbia Provincial Sales Tax (PST) where required by law. Listers are responsible for any income tax obligations on earnings.
Payments are processed securely by Stripe. By using the platform you agree to Stripe's terms.
6. Cancellation and Refunds
Each listing is governed by one of three cancellation policies set by the Lister. The applicable policy is shown on the listing page and at checkout. Full details are in our Cancellation Policy.

Service fees are non-refundable once a booking is confirmed, except where required by BC law.
7. Damage, Loss, and Liability
Renters are responsible for returning items in the same condition they were received, accounting for normal wear. If an item is damaged or lost during the rental period, the Renter is liable for repair or replacement costs up to the fair market value of the item.
RentalHive strongly recommends that Listers photograph their item before and after each rental, and that both parties confirm the item's condition at pickup and return.
RentalHive does not provide insurance. Users are encouraged to verify whether their existing home, tenant, or business insurance covers peer-to-peer rentals.
8. Prohibited Uses
You may not use RentalHive to:
- List items you do not own or have authority to rent.
- List illegal items or items that require a licence you do not hold.
- Circumvent platform fees by transacting off-platform.
- Submit false reviews or misrepresent your identity.
- Use the platform for commercial resale or sub-rental without our written consent.
Violations may result in account suspension and recovery of damages.
9. Disclaimer of Warranties
RentalHive provides the platform on an "as-is" and "as-available" basis without warranties of any kind, express or implied, to the maximum extent permitted by applicable BC law. We do not warrant that the platform will be uninterrupted or error-free, or that any listing is accurate or safe.
10. Limitation of Liability
To the maximum extent permitted by applicable British Columbia law, RentalHive's total liability to any User for any claim arising out of or related to these Terms or the platform shall not exceed the greater of (a) the fees paid by that User in the 12 months preceding the claim, or (b) CAD $100.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under the Business Practices and Consumer Protection Act (BC) or other applicable BC law.
11. Dispute Resolution
We encourage Users to resolve disputes directly. If a dispute cannot be resolved informally, either party may bring a claim before:
- The BC Civil Resolution Tribunal (CRT) for claims up to CAD $5,000 — civilresolutionbc.ca
- BC Small Claims Court for claims up to CAD $35,000.
- Any court of competent jurisdiction in British Columbia for larger claims.
These Terms do not require mandatory pre-dispute arbitration. Any voluntary arbitration agreed to after a dispute arises remains an option for both parties.
12. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts of BC for any dispute not resolved through the CRT or Small Claims process.
13. Privacy
We collect and use your personal information in accordance with our Privacy Policy and the Personal Information Protection Act (BC PIPA).
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or a prominent notice on the platform at least 30 days before they take effect. Continued use of RentalHive after the effective date constitutes acceptance of the revised Terms.
